Abandoned, Derelict or At-Risk Recreational Vessels, Model Procedure 2026

This document provides a model framework for states to establish consistent procedures for identifying, investigating, recovering, and disposing of abandoned, derelict, and at-risk recreational vessels. Developed through the National Association of State Boating Law Administrators (NASBLA), the model procedure defines each vessel category and outlines the circumstances under which a vessel may be considered abandoned, derelict, or at risk of becoming derelict. The guidance addresses public waterways, public lands, private property, marinas, and other marine facilities, while emphasizing the importance of timely reporting, investigation, owner notification, and coordination among law enforcement agencies, vessel owners, and interested parties.

The document also establishes a detailed process for ownership notification, publication requirements, transfer of ownership rights, registration and titling procedures, and cost recovery associated with vessel removal and disposition. Included are model affidavits, sample notices, and template correspondence designed to help states implement clear, legally defensible abandoned-vessel programs. By promoting standardized practices and due process protections, the guidance serves as a valuable resource for policymakers, boating law administrators, and waterway managers seeking to address vessel abandonment, reduce environmental and navigational hazards, and improve management of recreational vessels across state jurisdictions.
